Family law in T&T — what to know.

Divorce in Trinidad and Tobago is governed by the Matrimonial Proceedings and Property Act and is granted on the single ground of irretrievable breakdown of marriage, which must be evidenced by one of five facts: adultery, behaviour, desertion, two years’ separation with consent, or five years’ separation. Many uncontested divorces can be completed in six to twelve months; contested matters take longer.

The Cohabitational Relationships Act recognises certain rights for couples who have lived together as if in a marriage for at least five years — a fact that surprises many clients, and that affects how property and maintenance are dealt with on separation.

Child custody and maintenance matters are dealt with by the Children Court and Family Court, with the welfare of the child as the paramount consideration. The court takes into account the child’s wishes (where age-appropriate), the parents’ circumstances, and the practicalities of any arrangement proposed.

Our approach.

Family law sits at the intersection of legal procedure and personal circumstance. Our first task in any family matter is to understand both: what the client actually wants from the process, and what is realistically achievable given the law and the facts.

Where matters can be resolved by agreement, we work toward that outcome. Negotiated settlements are usually faster, less expensive and less damaging to relationships than contested proceedings, particularly where children are involved. Where settlement is not possible or not appropriate, we represent clients firmly through the court process.

We are direct about timelines and cost. Family matters can extend over months, sometimes years. Clients receive an honest assessment of what to expect — financially and emotionally — before they commit to a course of action.

Common questions.

How long does a divorce take in Trinidad?

An uncontested divorce typically takes six to twelve months from filing to decree absolute. Contested divorces — particularly those involving disputed property or custody — can take eighteen months or longer.

Do I need to be separated before filing for divorce?

It depends on the basis. Divorces filed on the grounds of adultery or unreasonable behaviour do not require a prior separation period. Divorces filed on the basis of separation require either two years (with the spouse’s consent) or five years (without consent).

How is child maintenance calculated in T&T?

There is no rigid formula. The court considers the income and assets of both parents, the needs of the child, the standard of living before separation, and other relevant factors. Either parent can apply to the Family Court or Children Court for an assessment.

Can common-law partners claim property on separation?

Yes, under the Cohabitational Relationships Act. Where a couple has lived together as if married for at least five years, certain rights to property and maintenance arise on separation. The same rights may apply where the couple has had a child together.

What if my spouse is abroad?

Divorce and family matters can proceed with one spouse abroad. Service of court documents internationally is a regular part of practice. We have handled multiple matters in which one party lives in the United States, Canada, Venezuela, Guyana, the Bahamas or the United Kingdom while the other remains in Trinidad.
